Expungement seals a criminal record from public view after the court issues an order and BCI processes it. For Sevier County cases, the petition is filed with the Sixth District Court in Richfield. Utah's Clean Slate law, effective February 2022, allows automatic expungement of qualifying lower-level offenses without requiring a petition in many situations.

For cases requiring a petition, BCI issues a Certificate of Eligibility for $65 after reviewing the application. The court petition fee is $135. After the court approves the expungement, BCI updates the state database, notifies the FBI, and sends a confirmation letter to the individual. That confirmation letter serves as official proof the record was removed from state and federal databases. Expunged records can still be accessed by government entities for limited purposes, such as sentencing in future felony cases. For most private and public background checks, the expunged record will not appear. More details are available through the Utah Courts expungement guide.
